These Terms of Service ("Terms") govern your access to and use of the TransitSafe website, applications, services, and related products (collectively, the "Services"). By using our Services you agree to be bound by these Terms. If you do not agree, please do not use the Services.

By accessing or using the Services you accept and agree to these Terms, our Privacy Policy, and any other policies posted by TransitSafe. We may require you to accept additional terms for certain features or integrations.

You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into a contract to use the Services. Use of certain features (for example, driver/operator accounts or financial products) may require additional verification.

TransitSafe facilitates payments through third-party payment processors and partner financial institutions. By using payment features you agree to their terms as well as ours.

Refunds for paid services are handled in accordance with our refund policy and the policies of payment processors. If you believe a transaction is incorrect, contact our support team and we will investigate.

TransitSafe integrates with third-party payment providers, banks, and analytics services. Those providers may have separate terms, and we are not responsible for their actions. Use of third-party services is at your own risk.

All content, logos, trademarks, and software on the Services are the property of TransitSafe or its licensors and are protected by law. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

If you submit feedback, ideas, or suggestions ("Feedback"), you grant TransitSafe a worldwide, royalty-free, perpetual, irrevocable license to use, modify, and incorporate the Feedback into our Services without restriction or compensation to you.

The Services are provided "as is" and "as available." TransitSafe makes no warranties, express or implied, about the reliability, suitability, or availability of the Services. To the maximum extent permitted by law, we disclaim all warranties including merchantability and fitness for a particular purpose.

Except where prohibited by law, TransitSafe and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services. Our aggregate liability for direct damages will not exceed the amount you paid us in the 12 months preceding the claim, or USD 100, whichever is greater.

You agree to indemnify, defend, and hold harmless TransitSafe, its officers, employees, and agents from any claims, liabilities, losses, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.

13. Suspension & Termination

We may suspend or terminate your access to the Services for violations of these Terms, suspected fraud, or for legal or regulatory reasons. On termination, your right to access the Services will end and any outstanding obligations will survive.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of Kenya (or your local jurisdiction where required). Any dispute relating to these Terms shall be resolved through good-faith negotiation. If unresolved, disputes may be submitted to the competent courts of Nairobi, Kenya, unless mandatory law provides otherwise.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you by posting a prominent notice or emailing account holders. Continued use of the Services after the effective date indicates your acceptance of the updated Terms.
